These Terms and Conditions (“Terms”) apply to all bookings, tours, services, activities, proposals, itineraries, and travel experiences provided by Beyond the Andes Soul S.A.C. (“the Company”, “we”, “us”, or “our”).
By booking, confirming, paying for, or participating in any service offered by the Company, the Client confirms that they have read, understood, and accepted these Terms in full.
Beyond the Andes works mainly with private, personalized, and carefully designed travel experiences. For this reason, certain operational conditions, schedules, inclusions, adjustments, and service arrangements may vary depending on the specific itinerary, client needs, supplier availability, destination conditions, and written agreements made before or during the service.
These Terms are aligned with applicable Peruvian consumer protection, tourism, personal data protection, civil, and commercial regulations, as well as responsible travel and international tourism service standards.
If you do not agree, you must discontinue use immediately.
These Terms are aligned with:
- Peruvian Consumer Protection Code (Law No. 29571)
- General Tourism Law (Law No. 29408)
- Peruvian Personal Data Protection Law (Law No. 29733)
- UNWTO international travel standards
- Industry norms for adventure tourism and high-altitude travel.
Definitions
- Client / Participant: The individual booking or participating in any Company service.
- Company: Beyond the Andes Soul S.A.C.
- Service: Any tour, itinerary, activity, excursion, travel experience, package, reservation, or related service offered or coordinated by the Company.
- Third-Party Provider: Hotels, transportation companies, train companies, guides, restaurants, entrance ticket providers, local operators, accommodation providers, insurance providers, or any external supplier involved in the delivery of a service.
- Private and Personalized Service: A travel experience designed or adapted according to the Client’s interests, pace, preferences, needs, or travel context, subject to operational feasibility, availability, safety, and supplier conditions.
1.- Contract Formation.
A booking becomes confirmed and binding only when:
- The Company accepts the reservation.
- The Client receives written confirmation from the Company.
- The required deposit, partial payment, or full payment has been received.
Only written confirmations sent by the Company through official communication channels are valid. General inquiries, verbal conversations, informal messages, screenshots, social media interactions, or unconfirmed proposals do not constitute a confirmed booking.
The Company may issue a proposal, itinerary, quotation, or proforma before confirmation. These documents are subject to availability and may change until the required payment and written confirmation are completed.
2.- Booking & Payment Terms
Deposits or partial payments may be required to confirm reservations. The amount, deadline, and payment conditions will be informed before payment through the corresponding quotation, proposal, invoice, confirmation document, or written communication.
Some services may require full or non-refundable payment in advance, including but not limited to:
- Machu Picchu tickets
- Train tickets
- Entrance permits
- Hotels with strict cancellation policies
- Special reservations requested by the Client
- Services booked under limited availability or high-season conditions
- Third-party services issued under the Client’s name
If payment deadlines are not met, the Company may cancel or release reservations without refund of any non-refundable deposit or supplier cost already incurred.
Accepted payment methods will be informed in the corresponding quotation or confirmation document and may include bank transfers, card payments, or authorized digital payment platforms when available.
All bank charges, transfer fees, currency exchange costs, intermediary bank fees, or platform commissions must be covered by the Client, unless otherwise agreed in writing.
For digital payments, the Client must only use the official payment instructions provided in writing by Beyond the Andes Soul S.A.C. The Company does not request confidential banking passwords, card PINs, complete card security codes, or sensitive financial credentials through the Website, WhatsApp, email, or social media. When payment links or third-party platforms are used, they will be informed through official Company channels.
3.- Pricing, Inclusions & Exclusions
Prices include only the services explicitly listed in the itinerary, quotation, or confirmation document provided to the Client.
Typical inclusions may include, when stated:
- Professional local guides
- Private or shared transportation
- Entrance tickets
- Permits
- Meals
- Accommodation
- Train or bus tickets
- Assistance and coordination services
Typical exclusions may include, unless expressly stated:
- Travel insurance
- International or domestic flights
- Tips
- Personal purchases
- Additional food or drinks
- Extra nights
- Personal changes to the itinerary
- Medical expenses
- Emergency evacuation
- Bank fees or payment platform commissions
- Services not expressly listed as included
Prices may change due to:
- Government tax updates
- New entrance fees
- Provider rate adjustments
- Currency fluctuations
- High-season availability
- Changes requested by the Client
- Operational changes outside the Company’s control
The Company will inform the Client when any applicable change affects the confirmed service.
4.- Cancellation & Refund Policy
4.1 Cancellations by the Client
Cancellation and refund conditions may vary depending on the type of service, travel date, supplier policies, ticket rules, hotel terms, transportation arrangements, permits, and other third-party provider conditions.
Because many travel services in Peru involve providers with their own cancellation and refund rules, the Company cannot guarantee a fixed refund percentage in all cases.
When a Client requests a cancellation, the Company will review each case individually and will make reasonable efforts to obtain the best possible outcome for the Client, seeking the greatest benefit or the lowest possible loss, according to the actual conditions of the reservation and the policies of the providers involved.
Refunds may depend on factors such as:
- Cancellation policies of hotels and accommodation providers
- Train, bus, or transportation provider rules
- Entrance tickets or permits issued under the Client’s name
- Local guide, restaurant, vehicle, or service provider conditions
- Administrative costs already incurred
- Bank or payment platform fees
- Date of cancellation
- High-season or limited-availability conditions
- Special arrangements requested by the Client
Non-refundable or partially refundable items may include, but are not limited to:
- Machu Picchu permits and entrance tickets
- Train tickets issued by PeruRail, Inca Rail, or other providers
- Hotels with strict cancellation policies
- Entrance fees issued under the Client’s name
- Special services reserved per request
- Provider deposits
- Tickets, permits, or reservations subject to third-party rules
These conditions are governed by the corresponding providers’ own policies and may not be controlled directly by the Company.
Whenever possible, the Company will communicate the estimated refundable amount, non-refundable components, supplier penalties, and administrative considerations before processing any refund.
4.2 General Refund Reference
Unless a specific quotation, proposal, confirmation document, supplier condition, or written agreement states otherwise, the following may be used as a general reference:
- More than 30 days before the service: refund possibilities may be reviewed, excluding non-refundable supplier costs and administrative costs already incurred.
- 15 to 30 days before the service: refunds may be limited and subject to supplier policies.
- Less than 15 days before the service: refunds are usually limited or not available, especially when reservations, tickets, hotels, guides, vehicles, or permits have already been confirmed.
- Less than 7 days before the service or no-show: no refund is usually available.
This reference does not override specific supplier policies or written agreements made for a particular service.
4.3 No-Shows
If the Client does not appear at the agreed place and time, the service will be considered a no-show.
No refund will be provided for no-shows, unused services, missed departures, missed trains, missed tickets, missed entrances, or services lost due to delay or absence of the Client.
4.4 Partial Participation
If the Client voluntarily abandons the tour, skips activities, refuses to continue, or decides not to use any part of the confirmed service, no refund will be provided for the unused portions.
The Company may assist with alternatives when possible, but additional costs will be the Client’s responsibility.
5.- Changes by the Client
Any modification requested by the Client must be made in writing and is subject to availability, operational feasibility, safety, supplier conditions, and possible additional costs.
Changes may incur:
- Re booking fees
- Supplier penalties
- New price differences
- Administrative costs
- Transportation or guide schedule adjustments
- Hotel or ticket modification costs
Some items cannot be modified once issued, including certain train tickets, entrance permits, Machu Picchu tickets, hotels, and services issued under the Client’s name.
Because the Company primarily works with private and personalized experiences, some adjustments may be possible depending on the case, the Client’s needs, and operational conditions. However, flexibility is not guaranteed when third-party rules, availability, safety, or timing prevent changes.
7.1 Small Group Experience
Although Beyond the Andes mainly focuses on private and personalized travel, some services may be offered as small group experiences.
In small group experiences, which are shared and not private services, the itinerary, schedule, route, and operational decisions may be less flexible because the convenience, timing, and safety of the whole group must be considered.
Changes to departure times, routes, activities, stops, pace, or schedules may not be possible unless the Company, the guide, and the group consider them reasonable, safe, and operationally feasible.
8.- Changes by the Company
The Company may modify itineraries, schedules, routes, activities, or service arrangements when necessary due to circumstances beyond its control, including but not limited to:
- Weather conditions
- Road blockades
- Strikes or political unrest
- Natural events
- Operational issues
- Provider failures
- Government restrictions
- Site closures
- Health or safety concerns
- Train, transport, or hotel disruptions
Whenever possible, the Company will offer an equivalent or reasonable alternative.
Such adjustments do not automatically constitute grounds for refund unless the entire activity or essential service must be cancelled and no reasonable alternative can be provided.
The Company prioritizes Client safety, service quality, and operational responsibility over strict itinerary completion.
9.- Client Responsibilities
The Client agrees to:
- Follow guide instructions for personal safety
- Respect local communities, cultural sites, animals, nature, and private property
- Use gear appropriate for altitude, terrain, weather, and activity type
- Arrive on time for all departures and scheduled services
- Provide accurate personal data and travel information
- Act responsibly and respectfully during the tour
- Inform the Company of relevant health, mobility, dietary, or personal conditions
- Carry necessary documents, medication, clothing, and personal items
The Company may suspend, modify, or terminate participation of any Client whose behavior threatens safety, damages property, affects the group, disrespects communities, or compromises the integrity of the experience.
In such cases, no refund will be provided.
10.- Health, Medical Conditions & Fitness Requirements
Mandatory Disclosure
The Client must inform the Company before booking of any relevant condition that may affect participation, including but not limited to:
- Chronic illness
- Disability or mobility limitation
- Recent surgery
- Allergies
- Asthma or respiratory conditions
- Heart conditions
- Psychological conditions affecting participation
- Medication requirements
- Dietary restrictions
- Pregnancy
- Any condition requiring special assistance
Failure to disclose relevant information may limit the Company’s ability to provide appropriate assistance and may release the Company from liability to the extent permitted by applicable law.
Fitness Requirements
Some Company services may involve:
- High altitude
- Long walks
- Uneven terrain
- Cold temperatures
- Intense sun exposure
- Remote locations
- Physical effort
- Potential altitude sickness
The Client accepts the inherent risks associated with travel, outdoor activities, high-altitude environments, and remote destinations.
Medical Emergencies
If evacuation, medical attention, special transportation, hotel extension, itinerary modification, or emergency assistance is required, all related costs are the Client’s responsibility unless otherwise covered by insurance or a specific written agreement.
The Company will assist reasonably when possible, but it is not financially liable for medical, evacuation, or emergency costs.
Travel insurance is strongly recommended for all Clients.
11.- High-Altitude Risks
The Client acknowledges that many destinations in Cusco and the Andes are located at high altitude.
Altitude sickness can affect anyone, regardless of age, experience, or physical condition. Symptoms may range from mild discomfort to serious medical situations.
Tours may be modified, delayed, interrupted, or cancelled if the guide or Company considers it unsafe to continue.
The Company prioritizes safety over itinerary completion.
12. Travel Documentation
The Client is responsible for having valid and correct travel documentation, including:
- Passport
- Visa, if required
- Vaccination documents, if required
- Immigration documents
- Travel insurance documents
- Required identification for tickets, permits, hotels, trains, or entrance controls
The Company is not responsible for denied entry, missed services, penalties, extra costs, or cancellation caused by incorrect, expired, incomplete, or missing documentation.
13. Third-Party Providers
The Company works with trusted third-party providers to deliver certain services. However, the Company does not directly control all operations, policies, schedules, or decisions of these providers.
Third-party providers may include:
- Hotels
- Train companies
- Transportation companies
- Restaurants
- Local guides
- Entrance ticket providers
- Local communities
- Partner agencies
- Insurance providers
- Specialized service providers
To the extent permitted by applicable law, the Company is not responsible for failures, delays, changes, cancellations, penalties, service limitations, or policies imposed by third-party providers.
This may include:
- Train delays or cancellations
- Flight changes
- Hotel service failures
- Transport breakdowns
- Provider strikes
- Provider errors
- Entrance restrictions
- Overbooking or availability changes
- Changes in provider cancellation or refund policies
When such situations occur, the Company will assist the Client and seek reasonable solutions whenever possible.
14. Liability Limitations
To the extent permitted by applicable law:
- Participation in activities is voluntary.
- The Company is not responsible for injury, illness, delay, damage, loss, inconvenience, or additional expense caused by events outside its reasonable control.
- The Company is not responsible for items lost, forgotten, stolen, damaged, or left behind during the service.
- The Company is not responsible for accidents, negligence, or failures caused by third parties, unless otherwise established by applicable law.
Possible risk factors may include:
- Weather
- Animal encounters
- Altitude
- Terrain conditions
- Strikes
- Acts of nature
- Road closures
- Theft
- Accidents caused by third parties
- Health conditions
- Client negligence
- Failure to follow guide instructions
Nothing in these Terms shall limit rights that cannot legally be waived under applicable consumer protection laws.
15. Force Majeure
Events outside the Company’s control may include, but are not limited to:
- Natural disasters
- Pandemics
- Political unrest
- Strikes
- Road blockades
- Government actions
- Weather conditions
- Unexpected site closures
- Social conflicts
- Public health restrictions
- Transportation disruptions
- Safety emergencies
In such cases, the Company may modify, postpone, replace, or cancel services depending on safety and operational feasibility.
Refunds, credits, rescheduling, or alternatives will depend on provider rules, actual costs incurred, and operational possibilities.
16. Photography, Video & Media Use
The Client’s image, photos, videos, testimonials, or personal travel content will only be used for marketing or public communication with explicit written consent.
If consent is not granted, the Company will not intentionally use the Client’s personal image for promotional purposes.
The Client may also request removal of previously authorized material when reasonably possible, subject to technical, legal, and operational limitations.
17. Privacy & Data Protection
The Company processes personal data in accordance with applicable Peruvian data protection regulations and international privacy principles.
Personal data is used only for operational, administrative, reservation, service, communication, and legal purposes.
The Company does not sell, rent, or trade personal data.

18. Governing Law & Jurisdiction
These Terms are governed by the laws of the Republic of Peru.
Any dispute arising from the interpretation, validity, execution, or termination of these Terms shall be submitted to the competent authorities or courts of Cusco, Peru, unless otherwise required by applicable law.
